Grammy nominees Coldplay have been sued by rock guitarist Joe Satriani, who claims the band's song Viva La Vida uses one of his riffs.

In court papers filed in Los Angeles on Thursday, he said the song used "substantial original portions" of his 2004 instrumental If I Could Fly. Satriani, 52, wants a jury trial and is seeking damages and "any and all profits" for the alleged plagiarism. Coldplay are shortlisted for seven Grammys, including song of the year. Viva La Vida is credited to the band's four members - singer Chris Martin, bass player Guy Berryman, guitarist Johnny Buckland and drummer Will Champion. The song's title was inspired by Mexican artist Frida Kahlo. It appeared on the album Viva La Vida or Death and All His Friends - which was released in June and went to number one in 36 countries - and was also one of their hit singles. Satriani's track appears on his album Is There Love in Space?

I stumbled across that very video a few months ago when the single was first released and couldn't figure out why Joe wasn't suing, as there is a likeness that is difficult to deny. I'm glad to hear that he's made the decision to go through the necessary legal procedures because it would almost be unjust that a 'pop'-type band could profit off of something an underdog (I have to face it, scarce few North Americans who aren't guitarists know of him) worked hard to create.

A member of another forum I frequent, the Dr. Z forum, mentioned an interesting precedent of Harrison Vs. the Chiffons (?) regarding My sweet Lord/He's so fine, "Harrison ended up paying simply based on a demonstration that both songs had the same relative notes, the same meter, the same verse/chorus construction etc."

Even disliking that ever repeating go to sleep fabric softener slowpoke stuff by Coldplay and greatly respecting Joe and his music... to my ears it's a nice sounding but quite natural and amazingly uncreative melody that I think emerges very easily when improvising over that certain chord progression with a laid back feel.
Especially with great music lurking every corner in your mind it can happen to reinvent a riff or line not knowing it and not doing it intentionally. I was lucky to find out early enough that a cool 13/8 riff I came up with was actually by Spock's Beard.

It just happens... though it's sad it happens in an industry with thousands of ears listening to it before it gets released.

Nef, I thought a similar thing. There are so many releases now that all a person would have to do is TRY to find these similarities and then capitalize on bringing them to people that would benefit in court. But I think Joe's been directly ripped by these lame asses. I'm so glad I don't listen to pop.

But even if Joe knew right away why not let it generate some chart topping cash to be reclaimed after the suit. Wouldn't the song be pulled from everything after a plagiarism suit? I mean otherwise they'd keep playing it as Coldplay but Joe would get all the royalties? OR Joe owns it? Seems like if Coldplay wasn't getting payed that they'd pull it. Ahh law suits. In a way I'm kind of disappointed that Joe took that path. But then I really like him so it's hard to hold it against him.

I give Coldplay a pass, it's so simple music that it would be easy for people to come up with the same melody. Especially with people listening to the same influences. Suspicion ain't guilt unless somebody confesses.

OK, I give it to you that they are similar but over those chords it is a fairly natural melody to play and they are not identical, hence why he is using the word plagiarism and not theft.

Is Satriani so poor he needs to resort to this kind of law suit?  How many Coldplay fans would have even heard of Satriani or even heard that track?  If this goes through and he wins it sets a precedent that would bring hundreds, maybe thousands, of similar lawsuits to the courts.  It is simply ridiculous. There are only a finite number of chords and progressions to play with a pop song so these things are bound to happen.  It smacks to me of some kind of publicity stunt to get Mr S some more media attention.  Perhaps there is also some jealousy that Viva La Vida was a no 1 album in 36 countries and Satch hasn't got the same recognition.

Sorry, but I think this should be thrown out of court.

Clever.

I see both sides. There should be laws protecting someones creative work. On the other hand, I hear tid bits of published works within other songs all the time.

One game I sometimes play is a sort of "guess that tune". I am amazed to realize how many hit songs have the same melody/progresions as others.

On the flip side, its amazing how many times the same exact phrase or word sequence is used in many different pop songs (usually involving cheesy rhymes).

Frankly, I think the statute of limitations and leeway should be loosened up a bit.

He's So Fine is no My Sweat Lord. I dont care what the jury found.

In my opinion the Coldplay song is a rip off. Have you heard the songs superimposed on one another? Joe could be playing in their band.

Intent is not part of the law as I understand it.

There is a web site with ten examples all of which had to pay the original composer and none are as obvious as the Joe/Coldplay song.

Some like My sweet Lord and He's so Fine shouldn't have won but did.

The chord changes aren't copyright protected and can't be but the melody is and has been copied exactly with some changed inflections. I don't think that the pitches, accents and rhythm are all going to match even in a simple song. It's been copped for sure.

I trust your opinion  its that obvious and then sure there should be compensation.
